Sale contingency, temporary lease and condo resale certificate
Selling a House and Buying at 2727 Kirby: The Texas Forms That Tie the Two Deals Together
Updated October 2026
Should I sell my Houston house first or buy at 2727 Kirby first, and which Texas forms connect the two deals?
In October 2026, a buyer who cannot purchase at 2727 Kirby until a house sells and closes uses the Addendum for Sale of Other Property by Buyer.

Which TREC contract covers the house, and which covers the unit at 2727 Kirby?
For the resale of a house, the Texas Real Estate Commission publishes the One to Four Family Residential Contract (Resale).
That contract has a stated reach. TREC says it covers a single family home, a duplex, a tri-plex or a four-plex.
It stops at the door of a condominium tower. TREC states that it is not for condominium transactions, new homes sold by a builder, or farm and ranch properties. A home at 2727 Kirby is a condominium unit, so the purchase runs on a different form.
On a resale here, that form is TREC's Residential Condominium Contract (Resale). It carries paragraphs a house contract lacks: delivery of the declaration, bylaws and rules, the resale certificate, and any right of first refusal in the declaration.
So a sale and a purchase in the same season usually means two TREC contracts, each with its own effective date and its own deadlines.
It is not for use for condominium transactions, new homes being sold by a builder, or farm and ranch properties.
When does the sale-of-other-property addendum belong on an offer at 2727 Kirby?
TREC publishes an Addendum for Sale of Other Property by Buyer for a buyer who cannot purchase the new property unless the existing one is sold and closed. Both conditions sit in TREC's wording.
Attached to an offer on a unit here, it puts your house closing into the terms of the purchase. If the money from the house is what funds the unit, that is the situation TREC describes.
The building's pace bears on how such an offer is weighed. As of October 2026, the median home at 2727 Kirby took 40 days to go under contract, against 21.0 months of inventory.
Closings ran at 93.2 percent of the final asking price, so the list price here is an opening position. A contingent offer arrives in a building where the marketing period runs in months rather than weeks.
Read the addendum's own terms, including its deadlines, on the current form with whoever writes the offer.
This Addendum is used if the Buyers will be unable to buy the new property unless their existing property is sold and closed.
What changes at 2727 Kirby if you sell the house first, or buy the unit first?
Selling first takes the condition away. Once the house has closed, you are no longer a buyer who cannot purchase until it does, and an offer here can go in without the addendum.
The price of that order is the gap between the two closings. With a median of 40 days to contract and 4 closings in the trailing twelve months, the plan and exposure you want may not be listed when your house closes.
Buying first without the addendum means committing to the unit while the house is still for sale. Plan that only where the purchase can close whether or not the house has.
Buying first with the addendum keeps the two linked. The unit's calendar then runs beside the house's, and the condominium documents add deadlines of their own.
Which condominium documents set the calendar on the 2727 Kirby side?
The selling owner asks the association in writing for the resale certificate. Texas law gives the association ten days from receiving that request to furnish it, signed and dated, with its current operating budget.
The certificate must have been prepared no more than three months before the buyer receives it. Under TREC's condominium resale contract, it is prepared at the seller's expense.
In the box for a buyer who has not yet received the documents, the parties write in delivery deadlines counted from the effective date. After each delivery the buyer has seven days to terminate by written notice.
From the county, the declaration and its amendments answer the parking. An amendment recorded in August 2021 is indexed as the tenth amendment, concerning the reallocation of parking spaces.
Read the chain in order, from the 2009 instrument under file number 20090193056 forward, while the option period still carries its unrestricted right to terminate.
Who should fill in the forms on both deals at 2727 Kirby?
TREC attaches a caution to its own forms: mistakes in the use of a form may result in financial loss or a contract which is unenforceable. It sends anyone using them toward a real estate license holder or an attorney.
Two contracts, an addendum linking them and a resale certificate make four places for a wrong box or a missing date.

Questions & answers
2727 Kirby questions, answered
If the home I'm selling is a duplex, which TREC contract do I use before buying at 2727 Kirby?
TREC's One to Four Family Residential Contract (Resale) covers it. TREC describes that contract as the form for the resale of residential properties that are either a single family home, a duplex, a tri-plex or a four-plex. A duplex you are selling falls inside that list, so the same form applies as for a single family house.
Before the listing goes up, ask the license holder which addenda the duplex sale itself will need. Ask also which documents a buyer of the duplex will expect to see. Put those answers on one calendar with the 2727 Kirby offer. The sale and the purchase run on separate contracts, and the dates in one rarely line up with the other by accident.
Does TREC publish the listing agreement for the house I'm selling?
No. TREC's own list of forms says it does not promulgate listing or buyer representation agreements, property management contracts, forms for commercial property, or residential leases, other than temporary residential leases used in connection with a sale. The listing agreement for your house, and any buyer representation agreement for the 2727 Kirby purchase, come from outside TREC's promulgated set.
TREC's part in the two deals is the contracts and addenda: the one to four family contract on the house, the condominium resale contract on the unit, and an addendum where one deal depends on the other. The representation agreements are written between you and the brokers, so read their terms yourself. Since 1 January 2026, a Texas license holder doing brokerage for a prospective buyer must have a written agreement before showing residential property. That rule reaches a condominium unit.
Can I stay in my house after it closes while my 2727 Kirby purchase finishes?
Yes, if your buyer agrees, and TREC has paper for it. Its list of promulgated forms excludes residential leases with one exception: temporary residential leases used in connection with a sale. A short stay in the house after its closing, while the unit at 2727 Kirby is still under contract, is the kind of arrangement that exception covers.
Agree the terms in writing at the same time as the house contract, not afterward. Then line the stay up with the 2727 Kirby side. The resale certificate request, the seven-day windows after the documents arrive and the option period all sit on that calendar. Move-in days and elevator reservations at the building are rules-level matters, and the rules come from the seller with the declaration and bylaws.
Does the association have to use TREC's resale certificate form when I buy at 2727 Kirby?
Not by TREC's account. TREC's notice on its January 3, 2025 form changes says the updated Condominium Resale Certificate, TREC No. 32-5, is a voluntary-use form. Under TREC's condominium resale contract, the certificate must be in a form TREC promulgates or one the parties require. It must also contain at least what the Property Code requires.
So the document that reaches you may be the TREC form or another layout. What counts is the content: the periodic assessment on the unit, amounts the seller still owes, and capital expenditures approved for the next twelve months. The reserves, any pending suits and every transfer fee, with who receives it, belong there too. On TREC No. 32-5 those sit in lettered boxes, with the operating budget, insurance summary and balance sheet attached. Whatever layout arrives, check each statement before your window to act on it closes.
My house is under contract but hasn't closed. Do I still need the sale-of-other-property addendum for 2727 Kirby?
TREC's description turns on two words: the addendum is for buyers unable to buy the new property unless their existing property is sold and closed. A signed contract on the house is the first of those, not the second. If the 2727 Kirby purchase still cannot close until the house closes, you are in the situation TREC describes.
A house closing date can move between signing and funding. Ask the license holder writing the 2727 Kirby offer how the addendum's terms handle a house that already has a buyer. Put the house's scheduled closing date beside the unit's, in writing. On the unit side, the resale certificate request and the parking reading keep their own clocks, whichever way the house goes.
