Texas property division and homestead refinance rules
Community Property, Owelty Liens and Refinancing a Home at 2727 Kirby
Updated October 2026
How do Texas community property rules and an owelty lien affect a court-ordered sale or refinance of a home?
In October 2026, Texas generally treats marital acquisitions as owned equally by both spouses, and an owelty lien is among the few debts a Texas home equity loan may share.

How do Texas community property rules and owelty liens work?
The Texas State Law Library says Texas is one of nine community property states. In general, its guide says, property a couple acquires during their marriage is equally owned by both spouses. The guide attaches a few exceptions to that rule.
The library's guide on property division says that during divorce proceedings, the court decides how the community property is divided.
The Texas Real Estate Research Center describes an owelty of partition as a payment made to equalize a division of property, by partition or by divorce. It may be secured by a lien, established either by court order or by written agreement.
That lien matters when a homestead is refinanced. The Texas Real Estate Research Center says that, when made, a home equity loan must be the only debt secured by the homestead, with listed exceptions. An owelty of partition is one of those exceptions. Those lending rules are written for a homestead.

What does a lender's appraisal rule mean for refinancing a home at 2727 Kirby?
Fannie Mae's Selling Guide describes Texas Section 50(a)(6) loans as ones that let a borrower take equity out of a homestead under certain conditions. For the fair market value acknowledgment, the guide says the value must be based on an appraisal. The appraisal must be attached to the written acknowledgment.
At 2727 Kirby, that appraisal rests on very few sales. The comparable set is usually three or four closed sales with the same exposure, floor plan and finish, some more than a year old.
With 4 closings in the trailing twelve months as of October 2026, one sale entering or leaving the window can move the building median. The median of $1,300,000 and the average of $576 per square foot do not value a specific home.
Parking belongs in the appraisal file as well. An amendment recorded in August 2021 is indexed as the tenth amendment to the declaration, concerning the reallocation of parking spaces. Confirm the recorded spaces for the unit before an appraiser relies on an older listing.
How does a court-ordered sale of a 2727 Kirby condo move?
The building's figures point to a long marketing period. As of October 2026, the median home here took 40 days to go under contract, against 21.0 months of inventory.
Closings ran at 93.2 percent of the final asking price. That ratio divides by the last price, so an earlier reduction does not show in it.
Where both parties must approve a sale, a shared evidence file gives each side the same facts to read. Build it from the handful of matched closed sales and what each one included.
The recorded chain sits in the Harris County Clerk's index, free to search by file number. The condominium instrument was filed on 7 May 2009 under file number 20090193056. A supplement followed on 4 May 2012 under file number 20120196965.
From the association, the current budget, the assessment history and recent board minutes say what the fee buys. They also show whether reserves are funded and whether a large repair is coming.

Questions & answers
2727 Kirby questions, answered
Does every owner and spouse have to agree to a Texas home equity loan on a homestead?
Yes, under the rule the Texas Real Estate Research Center describes. A Texas home equity loan must be secured by a voluntary lien on the homestead. That lien is created under a written agreement, with the consent of each owner and his or her spouse. Where a homestead at 2727 Kirby has more than one owner, every owner and every spouse consents in that written agreement.
Three conditions travel together. The lien is voluntary, it rests on a written agreement, and each owner and each spouse consents. Leave one out and the rule reads differently. Where co-owners disagree about refinancing, the consent requirement is where the plan stops until every signature is in place. Bring the documents that show who holds title, so the list of signers comes from paper rather than memory. The rule is stated for a homestead, and it says nothing about other property.
Which debts can stay on a homestead alongside a Texas home equity loan?
The Texas Real Estate Research Center lists five debts that may share the homestead with the loan. They are the purchase money, the taxes, an owelty of partition, a refinance of a lien against the homestead, and certain mechanics’ and materialmans’ liens. Apart from those, the home equity loan must be the only debt on the homestead when it is made.
The refinance item carries its own detail. It includes a federal tax lien resulting from the tax debt of both spouses, if the homestead is a family homestead, or from the tax debt of the owner. Which mechanics’ and materialmans’ liens qualify is a question for the lender and the title company. Before a refinance at 2727 Kirby, ask the title company for every lien of record on the unit. Then set each one against the five categories with your lender, before the application is filed.
How much equity has to stay in the home after a Texas home equity loan?
At least 20 percent. The Texas Real Estate Research Center states it plainly: the borrower must retain at least 20 percent equity in the home. On a 2727 Kirby condominium, that share is measured against a value an appraiser has to support with very few closed sales, so the comparables deserve attention before anything else.
The same source describes cash-out refinancing as taking out a home loan larger than the existing one. The 20 percent floor sets an upper limit on how far that new loan can reach. At this building, put the matched closed sales in front of the appraiser early. Note what each sale included down to its parking, because spaces here have been formally reallocated by recorded amendment. A value the comparables cannot carry shrinks the loan the equity rule allows.
When is the first payment due on a Texas cash-out home equity loan?
Fannie Mae's Selling Guide for Texas Section 50(a)(6) loans says the borrower’s first payment must be due no later than two months after closing. The count runs from the closing date. An owner refinancing a homestead at 2727 Kirby under that kind of loan should plan for the first payment inside that window.
The association's monthly assessment keeps running through a refinance. After an initial assessment, Texas condominium assessments are made at least annually on a budget the association adopts at least annually, so the figure can change from year to year. Ask the association in writing for a statement of what is owed on the unit before closing. That way the first loan payment and the next assessment sit on one calendar.
Who decides which condominium documents a court-ordered sale at 2727 Kirby needs?
The order and the lawyer handling it answer that, and the title company will read the order before closing. Whatever the paperwork requires, a buyer will still ask what a resale certificate would have answered: the assessment on the unit, any unpaid amounts, the reserves and the transfer fees. A written request to the association for a statement of what is owed puts those answers on paper.
Whether a sale is pursuant to court order is read from the order itself, so a title company will want to see it. The recorded declaration and its amendments still describe the unit's boundaries and its parking. Spaces at this condominium were moved between units by a recorded amendment, so the allocation for one home comes from reading the whole chain in order, from the declaration forward.
What will a buyer in a court-ordered sale at 2727 Kirby ask about the building's condition?
Much the same as any buyer here: the association's fees and assessments, the common areas, any notices of violations, any lawsuits, and alterations made without permits. Several of those can be answered from documents rather than memory. The association's records speak to fees, pending suits and code notices, and the building's facade work has a published record with dates on it.
Curtainwall Design Consulting records completion of the guardrail and podium cladding work in 2013 and states that all issues were rectified in 2014. What the association spent on that work, and what its reserves look like now, sit in its own financial records. In a sale both parties must approve, sharing those answers in writing keeps either side from relying on a recollection the other cannot check.
